| IUS CIVILE. HISTORY AND THEORY OF PRIVATE LAW |
The Phd programme "Ius civile. History and Theory of Private Law" focuses on the tradition of civil law, both historically and in a contemporary context, on the assumption of the intrinsic historicity of law and the need of analyzing legal institutions within their contexts. The aim of the programme is to foster a methodological approach where dogmatics is understood through history. The interdisciplinary nature of the programme justifies the inclusion of scholars specializing in various areas of law, including private law (GIUR-01/A), commercial law (GIUR-02/A), maritime and transport law (GIUR-02/B), economic law (GIUR-03/A), labour law (GIUR-04/A), comparative private law (GIUR-11/A), and Roman law (GIUR-15/A), but encompasses the entire civil law system, dealing also with European legal harmonization processes and potentially impacting the common law. The involvement of international scholars in the Doctoral Board significantly enriches the programme. In line with the educational programme, PhD students will primarily focus on private law institutions, examining their various historical phases up to their contemporary configuration. Students may choose to concentrate on Roman law, contemporary law, or trace the history of the institutions over time. In any case, it is considered essential that the study of each institution is contextualized within its specific time period. This approach creates an opportunity for students to broaden their knowledge beyond their specific research topics, thanks to interdisciplinary meetings, lectures, and seminars, and research period abroad.
