descrizione: | Il progetto di dottorato denominato Ius civile. Storia e teoria del diritto privato pone al centro del proprio interesse la tradizione giuridica del diritto privato — nella sua accezione più ampia — vista sia in prospettiva storica che nella sua dimensione attuale. Il progetto ha dunque carattere interdisciplinare, e nasce dalla consapevolezza dell’intrinseca storicità del diritto, e della necessità di esaminare gli istituti giuridici nel loro contesto di riferimento, con un occhio al passato e in vista degli sviluppi futuri. Lo studio del diritto romano è volto all’origine degli istituti, ricostruendone la formazione, e individua i concetti che costituiscono lo strumentario teorico del giurista moderno. Lo studio del diritto privato raccoglie l’esito della vicenda che l’istituto giuridico ha compiuto, indagandone nella contemporaneità la natura teorica e le applicazioni. La storia aiuta a colmare la distanza tra modelli antichi e moderni che una semplice comparazione tipologica non riesce a evidenziare, suggerendo le ragioni della continuità o discontinuità nella struttura degli istituti, e d’altra parte il percorso che conduce alla contemporaneità aiuta a comprendere i fenomeni storici. Può essere utile usare il termine tedesco Dogmengeschichte per evocare l’immagine di una dogmatica che si costruisce nella storia, nel costante dialogo tra passato e presente, tra diritto romano e diritto moderno. Naturalmente, poiché questo percorso non è circoscritto alla vicenda del diritto italiano, ma si estende all’intero sistema di civil law – e anzi anche oltre, in considerazione della forte interferenza con il common law in alcuni settori del diritto – e ai processi europei di armonizzazione del diritto, la partecipazione di studiosi stranieri nel Collegio di dottorato rappresenta un sicuro arricchimento del progetto formativo. Il carattere interdisciplinare del dottorato giustifica la presenza di studiosi di diritto privato (IUS/01), diritto commerciale (IUS/04), diritto dell’economia (IUS/05), diritto del lavoro (IUS/07), diritto romano (IUS/18). Coerentemente al progetto formativo, oggetto privilegiato di studio per i dottorandi saranno gli istituti giuridici privatistici studiati nelle loro diverse fasi storiche, sino alla configurazione attuale. Il dottorando potrà scegliere di concentrarsi sul diritto romano, sul diritto attuale, oppure tracciare l'intera storia dell’istituto: in ogni caso, lo studio non potrà prescindere dall'inserimento dell'istituto nel suo contesto (economico, sociale, culturale, ecc.). Al di là dello specifico tema di ricerca, ciascun dottorando avrà la possibilità di ampliare l’ambito delle proprie conoscenze grazie a incontri, lezioni e seminari, impostati in forma interdisciplinare.

description: | The PhD programme Ius Civile. History and Theory of Private Law focuses on the legal tradition of private law – in its broadest sense – seen both from a historical perspective and in its current dimension. The programme, therefore, has an interdisciplinary character and arises from the awareness of the intrinsic historicity of law and the need to examine legal institutes in their context, with an eye to past and future developments. The study of Roman law is aimed at the origin of the institutes, reconstructing their formation, and identifying the concepts that constitute the theoretical tools of the modern jurist. The study of private law gathers the outcome of the historical path that the legal institution has accomplished, investigating its theoretical nature and applications in the contemporary world. History helps bridge the gap between ancient and modern models that a simple typological comparison fails to highlight, and suggests the reasons for the continuity or discontinuity in the structure of the institutions, while, on the other hand, the path that leads to modernity helps in understanding the historical phenomena. It may be helpful to use the German term Dogmengeschichte to evoke the image of dogmatics built-in history, in the constant dialogue between past and present, between Roman law and contemporary law. Of course, since this path is not limited to Italian law but extends both to the entire Civil law system – and even beyond, in consideration of the substantial interference with the Common law in some areas – and to the European processes of harmonisation of law, the participation of foreign scholars in the PhD Board represents a sure enrichment of the programme. The interdisciplinary character of the PhD justifies the presence of scholars of private law (IUS/01), commercial law (IUS/04), economic law (IUS/05), labour law (IUS/07), and Roman law (IUS/18). Consistent with the educational project, the privileged object of study for students will be the institutes of private law studied in their historical process up to the current configuration. The student can choose to focus on Roman law or contemporary law, or trace the whole history of the institution: in any case, the study should take into account the economic, social and cultural context of the institution. Notwithstanding the specific research topic, each student will have the opportunity to expand the field of their knowledge thanks to meetings, lessons and seminars, organised in an interdisciplinary form. |
